General Terms and Conditions of Sale (GTC)<\/strong><\/span><\/h3>

These General Terms and Conditions of Sale (\u201cGTC\u201d) apply exclusively to current and future commercial relationships concluded between:<\/p>

SARL Arlis<\/strong>, trading as laplanetedesenfants.com<\/em>, with a share capital of \u20ac50,000, registered office at 7 Avenue de la Redoute, 92390 Villeneuve-la-Garenne, France, registered with the Nanterre Trade and Companies Register under number 827 585 910 (VAT No.: FR62 827 585 910), hereinafter referred to as \u201cthe Seller\u201d<\/strong> or \u201cthe Website\u201d<\/strong><\/p>

AND<\/strong><\/p>

Any natural or legal person with the legal capacity to make a purchase via the website https:\/\/www.laplanetedesenfants.com<\/a>, hereinafter referred to as \u201cthe Customer.\u201d

<\/strong><\/p>

Placing any order on the Website constitutes full and unconditional acceptance of these GTC. The applicable GTC are those in force on the date of the order and prevail over any other conditions not expressly accepted by the Seller.<\/p>

The Seller reserves the right to modify these GTC at any time. Customers must therefore review them before each order. The latest update date is indicated at the top of the page.<\/p>

For any pre-contractual questions, the Seller\u2019s Customer Service can be contacted.<\/p>

Article 1 \u2013 Scope of Application<\/strong><\/span><\/h3>

The GTC are available on the Website and must be accepted by the Customer before placing an order.<\/p>

  • Invalidity of one clause does not invalidate the entire GTC<\/li>
  • Non-application of a clause does not mean waiver of others<\/li>
  • The Seller is defined as an online toys and textile retailer<\/strong><\/li>
  • The Customer is the consumer placing the order<\/li><\/ul>

    Placing an order implies full acceptance of the GTC.<\/p>

    Article 2 \u2013 Orders<\/strong><\/span><\/h3>

    Orders can be placed online 24\/7.<\/p>

    Order steps:<\/strong><\/p>

    • Identify yourself<\/li>
    • Accept the GTC<\/li>
    • Complete payment (finalizes the contract)<\/li><\/ul>

      The Customer can review and correct the order before confirmation.<\/p>

      • Delivery deadline is shown before checkout<\/li>
      • Confirmation email is sent after order validation<\/li>
      • Records (orders, invoices) are stored as legal proof<\/li><\/ul>

        If a product is unavailable:<\/p>

        • The Customer is informed<\/li>
        • Refund or credit note is issued<\/li><\/ul>

          The Seller may refuse orders for legitimate reasons (e.g., unpaid debts or excessive quantities).<\/p>

          Article 3 \u2013 Prices, Products, Payment<\/strong><\/span><\/h3>
          • Prices are in euros, including VAT (except Switzerland)<\/li>
          • Prices may change, but the price at order time applies<\/li>
          • Shipping costs are calculated automatically<\/li><\/ul>

            Outside EU:<\/strong> Customs duties may apply and are paid by the Customer.<\/p>

            Payment methods:<\/strong><\/p>

            • Credit card (Visa, Mastercard, etc.) \u2013 secure encrypted system<\/li>
            • Bank cheque or bank transfer (processed after payment clearance)<\/li>
            • PayPal (5% surcharge applies)<\/li><\/ul>

              An acknowledgment email is sent after payment is received.<\/p>

              Article 4 \u2013 Delivery Time<\/strong><\/span><\/h3>

              Delivery time is indicated before order confirmation.<\/p>

              • Delivery must occur within the stated time or within 30 days<\/li>
              • If delayed, the Customer may cancel the order<\/li>
              • Refund must be issued within 14 days<\/li><\/ul>

                Article 5 \u2013 Delivery Methods and Costs<\/strong><\/span><\/h3>
                • Free delivery from \u20ac49 (relay point)<\/li>
                • Delivery = preparation (48\u201372h) + carrier time<\/li><\/ul>

                  Shipping rules:<\/p>

                  • Orders before 8 AM (Mon\u2013Fri) \u2192 same-day dispatch<\/li>
                  • Others \u2192 next working day<\/li><\/ul>

                    If delayed:<\/p>

                    • Investigation may be opened<\/li>
                    • Customer may cancel after 7 days delay<\/li><\/ul>

                      Customer must check goods upon delivery and report issues within 3 days.<\/p>

                      Minor packaging defects are not considered valid claims.<\/p>

                      Article 6 \u2013 Delivery Conditions<\/strong><\/span><\/h3>
                      • Delivery only in mainland France and Corsica<\/li>
                      • Bulky items delivered at doorstep only<\/li>
                      • Missed delivery \u2192 notice left<\/li><\/ul>

                        Separate orders required for multiple delivery addresses.<\/p>

                        Article 7 \u2013 Transport<\/strong><\/span><\/h3>

                        Delivery is handled by selected carriers.<\/p>

                        Customer must:<\/p>

                        • Inspect goods upon delivery<\/li>
                        • Report damages within 3 working days<\/li><\/ul>

                          Returns follow the withdrawal procedure.<\/p>

                          Article 8 \u2013 Transfer of Ownership<\/strong><\/span><\/h3>

                          Ownership transfers after full payment.<\/p>

                          Risk transfers upon delivery.<\/p>

                          Article 9 \u2013 Product Assembly<\/strong><\/span><\/h3>
                          • Installation is the Customer\u2019s responsibility<\/li>
                          • Instructions must be followed carefully<\/li>
                          • Delivery staff do not install products<\/li><\/ul>

                            Article 10 \u2013 Right of Withdrawal<\/strong><\/span><\/h3>
                            • 14-day withdrawal period from delivery<\/li>
                            • Products must be returned unused and complete<\/li><\/ul>

                              Refund:<\/p>

                              • Issued within 14 days<\/li>
                              • Return shipping costs are not included<\/li><\/ul>

                                Exceptions:<\/strong><\/p>

                                • Opened CDs\/DVDs<\/li>
                                • Food products<\/li><\/ul>

                                  Gift vouchers are non-refundable (refunded via bank cheque only).<\/p>

                                  Article 11 \u2013 Warranties<\/strong><\/span><\/h3>

                                  1. Legal conformity warranty<\/strong><\/h5>
                                  • Covers defects for 2 years<\/li><\/ul>
                                    2. Hidden defects warranty<\/strong><\/h5>
                                    • Covers undisclosed product faults<\/li><\/ul>
                                      3. Manufacturer warranty<\/h5>

                                      Exclusions:<\/strong><\/p>

                                      • Misuse<\/li>
                                      • Unauthorized repairs<\/li>
                                      • Wear and tear<\/li>
                                      • External causes<\/li><\/ul>

                                        Customer must keep the invoice as proof of purchase.<\/p>

                                        Article 12 \u2013 Personal Data<\/strong><\/span><\/h3>

                                        Customer data is processed according to French law.<\/p>

                                        • Right to access and correct data<\/li>
                                        • CNIL registration: No. 2133049<\/li><\/ul>

                                          Customers may receive marketing offers unless they opt out.<\/p>

                                          Article 13 \u2013 Liability<\/strong><\/span><\/h3>

                                          The Seller is responsible for proper execution but not for:<\/p>

                                          • Customer fault<\/li>
                                          • Third-party issues<\/li>
                                          • Force majeure<\/li>
                                          • Internet-related issues<\/li><\/ul>

                                            Article 14 \u2013 Intellectual Property<\/strong><\/span><\/h3>

                                            All Website content is protected.<\/p>

                                            • Reproduction or use without permission is prohibited<\/li>
                                            • Violations are subject to legal action<\/li><\/ul>

                                              Article 15 \u2013 Applicable Law and Jurisdiction<\/strong><\/span><\/h3>
