General Terms and Conditions of Sale (GTC)
These General Terms and Conditions of Sale (“GTC”) apply exclusively to current and future commercial relationships concluded between:
SARL Arlis, trading as laplanetedesenfants.com, with a share capital of €50,000, registered office at 7 Avenue de la Redoute, 92390 Villeneuve-la-Garenne, France, registered with the Nanterre Trade and Companies Register under number 827 585 910 (VAT No.: FR62 827 585 910), hereinafter referred to as “the Seller” or “the Website”
AND
Any natural or legal person with the legal capacity to make a purchase via the website https://www.laplanetedesenfants.com, hereinafter referred to as “the Customer.”
Placing any order on the Website constitutes full and unconditional acceptance of these GTC. The applicable GTC are those in force on the date of the order and prevail over any other conditions not expressly accepted by the Seller.
The Seller reserves the right to modify these GTC at any time. Customers must therefore review them before each order. The latest update date is indicated at the top of the page.
For any pre-contractual questions, the Seller’s Customer Service can be contacted.
Article 1 – Scope of Application
The GTC are available on the Website and must be accepted by the Customer before placing an order.
- Invalidity of one clause does not invalidate the entire GTC
- Non-application of a clause does not mean waiver of others
- The Seller is defined as an online toys and textile retailer
- The Customer is the consumer placing the order
Placing an order implies full acceptance of the GTC.
Article 2 – Orders
Orders can be placed online 24/7.
Order steps:
- Identify yourself
- Accept the GTC
- Complete payment (finalizes the contract)
The Customer can review and correct the order before confirmation.
- Delivery deadline is shown before checkout
- Confirmation email is sent after order validation
- Records (orders, invoices) are stored as legal proof
If a product is unavailable:
- The Customer is informed
- Refund or credit note is issued
The Seller may refuse orders for legitimate reasons (e.g., unpaid debts or excessive quantities).
Article 3 – Prices, Products, Payment
- Prices are in euros, including VAT (except Switzerland)
- Prices may change, but the price at order time applies
- Shipping costs are calculated automatically
Outside EU: Customs duties may apply and are paid by the Customer.
Payment methods:
- Credit card (Visa, Mastercard, etc.) – secure encrypted system
- Bank cheque or bank transfer (processed after payment clearance)
- PayPal (5% surcharge applies)
An acknowledgment email is sent after payment is received.
Article 4 – Delivery Time
Delivery time is indicated before order confirmation.
- Delivery must occur within the stated time or within 30 days
- If delayed, the Customer may cancel the order
- Refund must be issued within 14 days
Article 5 – Delivery Methods and Costs
- Free delivery from €49 (relay point)
- Delivery = preparation (48–72h) + carrier time
Shipping rules:
- Orders before 8 AM (Mon–Fri) → same-day dispatch
- Others → next working day
If delayed:
- Investigation may be opened
- Customer may cancel after 7 days delay
Customer must check goods upon delivery and report issues within 3 days.
Minor packaging defects are not considered valid claims.
Article 6 – Delivery Conditions
- Delivery only in mainland France and Corsica
- Bulky items delivered at doorstep only
- Missed delivery → notice left
Separate orders required for multiple delivery addresses.
Article 7 – Transport
Delivery is handled by selected carriers.
Customer must:
- Inspect goods upon delivery
- Report damages within 3 working days
Returns follow the withdrawal procedure.
Article 8 – Transfer of Ownership
Ownership transfers after full payment.
Risk transfers upon delivery.
Article 9 – Product Assembly
- Installation is the Customer’s responsibility
- Instructions must be followed carefully
- Delivery staff do not install products
Article 10 – Right of Withdrawal
- 14-day withdrawal period from delivery
- Products must be returned unused and complete
Refund:
- Issued within 14 days
- Return shipping costs are not included
Exceptions:
- Opened CDs/DVDs
- Food products
Gift vouchers are non-refundable (refunded via bank cheque only).
Article 11 – Warranties
Includes:
1. Legal conformity warranty
- Covers defects for 2 years
2. Hidden defects warranty
- Covers undisclosed product faults
3. Manufacturer warranty
Exclusions:
- Misuse
- Unauthorized repairs
- Wear and tear
- External causes
Customer must keep the invoice as proof of purchase.
Article 12 – Personal Data
Customer data is processed according to French law.
- Right to access and correct data
- CNIL registration: No. 2133049
Customers may receive marketing offers unless they opt out.
Article 13 – Liability
The Seller is responsible for proper execution but not for:
- Customer fault
- Third-party issues
- Force majeure
- Internet-related issues
Article 14 – Intellectual Property
All Website content is protected.
- Reproduction or use without permission is prohibited
- Violations are subject to legal action
Article 15 – Applicable Law and Jurisdiction
These GTC are governed by French law.
Disputes:
- Must first be addressed to Customer Service
- Mediation available via MEDICYS
- EU dispute platform available
Courts:
- Jurisdiction = defendant’s location or delivery location
